I was pillaging the Bungie Weekly Update and found out something interesting...when you melee eachother simultaneously, the person with more health wins.

Ok that might make sense now.. Is that why when i go to melee at the same time as my opponent, can hear the melee noise, and then i get slapped and my body flops 10 feet back?
if so thats one less thing to mute my mic and yell about
